Refund and Dispute Resolution Policy
This Refund and Dispute Resolution Policy explains the roles and responsibilities of "Users" ("Buyers" and "Sellers") regarding refunds and disputes for transactions that originate on the ORE2B marketplace (the "Portal").
This policy is a part of our main Terms of Use. By using the Portal, you acknowledge and agree to the terms outlined in this policy.
1. ORE2B's Role as a Neutral Venue
ORE2B provides a digital marketplace that allows Buyers and Sellers in the metals and mining industry to find and connect with each other. It is critical for all "Users" to understand that:
- ORE2B is a Neutral Venue: We are not an auctioneer, a seller, or a buyer. The Portal acts solely as a venue to allow "Users" to offer, sell, and buy goods and services.
- ORE2B is Not a Party to Transactions: Any agreement or contract for the sale of goods or services is made exclusively and directly between the Buyer and the Seller. ORE2B is not a party to any such contract and assumes no responsibility arising out of or in connection with it.
- ORE2B Does Not Mediate: ORE2B does not act as a mediator, arbitrator, escrow agent, or insurer. We do not get involved in disputes between "Users" regarding any transaction. We do not handle payments, shipping, quality assurance, or returns between "Users".
The enforcement of any contractual obligations arising out of an agreement between a Buyer and a Seller is the sole responsibility of the parties to that agreement.
2. User Responsibilities and Due Diligence
The responsibility for conducting business safely and professionally on the Portal rests entirely with the "Users". We strongly encourage all "Users" to:
- Perform Due Diligence: Before entering into any transaction, "Users" should conduct their own comprehensive due diligence on the other party. This may include requesting business references, verifying corporate documents, and checking creditworthiness.
- Agree on Terms in Advance: Buyers and Sellers should agree on all essential terms in a clear, written contract before any payment or shipment is made. This includes detailed product specifications, price, payment terms, shipping and delivery (Incoterms), insurance, and the procedure for returns or handling non-conforming goods.
- Use Secure Transaction Methods: "Users" should utilize secure and traceable payment methods, such as letters of credit (L/C) or third-party escrow services, especially for high-value transactions. ORE2B does not provide an escrow service.
- Utilize Third-Party Inspection: We highly recommend using reputable third-party inspection services to verify the quality, quantity, and specifications of goods before shipment or final payment.
3. The Dispute Resolution Process (Between Users)
ORE2B does not resolve disputes. The resolution of any disagreement, claim, or dispute is the sole responsibility of the Buyer and Seller. If an issue arises, we recommend the following steps:
Step 1: Direct Communication The Buyer and Seller must first attempt to resolve the issue directly and professionally through open communication. "Users" should keep a clear and documented record of all communications.
Step 2: External Legal and Formal Recourse If direct communication fails to resolve the dispute, the parties must pursue resolution through their own external means. This may include:
- Independent, third-party mediation or arbitration services.
- Filing a claim with the relevant legal authorities or courts of competent jurisdiction as specified in their commercial contract.
ORE2B will not provide legal advice or intervene in any legal proceedings between "Users".
4. Reporting Policy Violations
While ORE2B does not mediate transactional disputes, we are committed to maintaining the integrity of the Portal. "Users" can and should report any activity that violates ORE2B's other policies, such as the Listing Policy or Acceptable Use Policy.
Examples of reportable violations include:
- Fraudulent or misleading listings.
- Spam or harassment.
- Attempts to engage in illegal activities.
Reports can be submitted to [[email protected]]. Upon receiving a report, ORE2B may investigate the claim at its sole discretion. If a violation is confirmed, we may take action against the offending account, including suspension or termination, to protect the community. However, this action is separate from the resolution of any underlying financial or transactional dispute between the parties.
